Shipping and returns

1. Order fulfillment time

Orders are processed within two business days of receipt. Once the purchase is completed and the order confirmation email is received, orders will be processed. Delivery time of goods may vary depending on the product chosen, usually it is delivered in 1 business day. Fulfillment may be delayed during holidays. Orders will be processed and delivered Monday through Friday, excluding holidays and national holidays. IDENTITY SRL is not responsible for unforeseeable delays, it being understood that, except in cases of force majeure, the Products will be delivered within a maximum period of 20 (twenty) days from the day following the day on which the Customer issued the order to IDENTITY SRL. The day of delivery will depend on the destination location and the availability of the ordered goods. Deliveries are not made on holidays and pre-holidays.

2. Methods of delivery.

Product deliveries are made to the address indicated by the Customer in the purchase procedure through the carrier throughout the Italian territory with the exception of Campione D'Italia and Livigno. The carrier assumes full responsibility for transportation, from pickup at the supplier, until delivery to the address indicated. IDENTITY SRL assumes no responsibility for any damage or irregular behavior on the part of the carrier. It is possible to choose the most convenient place as the shipping address: your own residence, office or another person's address. Delivery of the goods requires the presence of the Customer or the Customer's agent at the recipient's address indicated in the order. No responsibility can be attributed to IDENTITY SRL in case of delay in the fulfillment of the order or delivery of what was ordered.

Upon delivery, the customer is required to check:
- that the packaging is intact, neither damaged, nor wet, or otherwise altered, even in the closing materials;
- that the number of packages corresponds to what is indicated in the transport document.

Any damage to the product or packaging or the mismatch of indications, must be immediately contested to the courier by affixing WRITTEN RESERVE OF CONTROL, on the courier's proof of delivery. Once the courier's document has been signed, the Customer will not be able to make any objection about the external characteristics of what has been delivered. In the event of failure to collect within 5 working days of the material in storage at the warehouses of the courier due to repeated inability to deliver to the address specified by the Customer when placing the order, the order will be canceled.

In the event that any product presented on the portal is no longer available or on sale at the time of the conclusion of the purchase transaction, IDENTITY SRL will communicate the inconvenience within 15 (fifteen) days from the day following the day of transmission. In case the Customer has already paid for the order, IDENTITY SRL will provide a full refund of the amount as soon as possible, and in any case no later than 30 (thirty) days from the receipt of the purchase order. For security reasons, no deliveries will be made to P.O. boxes and the order will therefore not be processed.

3. Methods of payment

For each order placed IDENTITY SRL issues a document of sale of the shipped material. For the issuance of the invoice, the information provided by the customer at the time of the order shall be authentic. The Customer may request a copy of the invoice or tax receipt within the period of three months after issuance.

Delivery charges are the responsibility of the Customer and are indicated at the time the order is placed unless clearly stated in the sales offer.

All prices on the site are intended to be public prices and, therefore, include VAT. Prices may vary without prior notice and the only correct price is to be understood as the one indicated at the time of order confirmation. On certain products, subject to price promotions, the seller reserves the right to accept orders by reducing the quantity, subject to prior notice and acceptance by the customer, failing which the order shall be deemed cancelled.

In cases of purchase of the goods with payment method "credit card", at the same time as the conclusion of the online transaction, the bank of reference will authorize only the commitment of the amount related to the purchase made. Upon request, an invoice of the goods shipped can be issued to the holder of the order, in accordance with D.P.R. 445/2000 and D.L. 52/2004. For the issuance of the invoice shall be based on the information provided by the Customer when placing the order. No change in the invoice will be possible after the issuance of the same.

Goods are sent only after order acceptance and receipt of credit.

In the event of cancellation of the order, either by the Customer (for the reasons set forth in point 4B below) or in the event of non-acceptance of the same by the seller due to causes not attributable to its will, the cancellation of the same will be carried out and the release of the committed amount (the time of release depends exclusively on the banking system). Carried out the cancellation of the transaction, the seller can not be held liable for any damages, resulting from the release of the amount committed by the banking system. IDENTITY SRL reserves the right to ask the Customer for additional documents proving the ownership of the credit card. Failure to send the documentation IDENTITY SRL reserves the right not to accept the order.

Transaction security is ensured by a data encryption system (SSL) and direct, secured and certified links.

4. Withdrawal & legal warranty

A. Legal Warranty

Products purchased are always accompanied by a legal warranty covering manufacturing defects. The legal warranty cannot be enforced by those who purchased the products as part of their business or professional activity, indicating their VAT number. The legal warranty gives the right to request from IDENTITY SRL, the replacement of the goods, free of charge, provided that the requested solution is not impossible or excessively burdensome, given: the magnitude of the possible defect, the value of the product without defect and whether the alternative can be implemented while avoiding significant inconvenience to the Customer; in the event that the repair or replacement is impossible, excessively burdensome or late or involves significant inconvenience to the Customer and is not effective in solving the problem the Customer has the right to request a price reduction. In determining the amount of the reduction, the use of the goods shall be taken into account. In any case, for minor defects for which the product could not be replaced, the contract may not be terminated. The seller shall make the replacement of the product within the maximum time of 30 days after delivery.

In order to enforce the warranty, the Customer must by law:
- retain and produce the purchase receipt;
- report the defect within seven days of its discovery;

B. Right of withdrawal

IDENTITY SRL reserves the right not to accept goods from the same order, returned and shipped at different times. The cost of returning the goods will be borne by the customer, including liability in case of loss or damage of the products.

In the event that there is no correspondence between the recipient of the products indicated in the order and the person who made the payment of the sums due for their purchase, the refund of the sums, in the event of the exercise of withdrawal, will be against the person who made the payment.

The online customer acting as a consumer is given the right to withdraw from the contract, as provided for in Articles 64 - 67 of Legislative Decree No. 206/2005, known as the Consumer Code. It should be noted that this right is reserved only for natural persons, that is, for those private consumers acting for purposes unrelated to their profession. There is no right of withdrawal for legal and natural persons who act, with reference to the purchase contract, in the professional sphere.

Pursuant to and within the limits of Article 64 of the Consumer Code, the consumer has the right, within 10 working days of receipt of the products purchased, to exercise the right of withdrawal, consisting of the possibility to return the products received and obtain a refund of the price paid, without penalty and without the need to specify the reason. This right applies to all products purchased online at this site. The cost of returning the product shall be borne by the consumer.

The right of withdrawal is totally forfeited if the returned product is not intact, due to the absence, for example, of integral elements of the product or because the product has been damaged for causes other than transportation from the Seller to the consumer, not previously reported. Without limiting the right of withdrawal, upon delivery of the product, the consumer, who has reason to believe that the product itself has been damaged during transport, must refuse the delivery or accept it with express reservation. Any withdrawal of undamaged packages must be made by the customer by affixing the words "INTEGRATED PACKAGE, WITH RESERVATION OF CONTROL CONTENT" on the appropriate accompanying document (art. 1698 Civil Code). Any anomaly must then be reported within eight days.

Procedure for exercising the right of withdrawal

In order to exercise the right of withdrawal, it is necessary to send, within 10 working days of receipt of the purchased product, a communication in which the will to withdraw from the purchase contract is clearly stated. Such notice must be sent, by registered letter with acknowledgment of receipt.

The notice may also be sent, within the same period, by telegram (to the company's address). The consumer must then provide, using a courier of his choice, the shipment of the product (if possible in the original packaging and, in any case, always carefully packed) and everything originally contained. The consumer must make such shipment within ten working days from the date on which he sent the notice of exercise of the right of withdrawal.

Important Notes

Transportation costs and responsibility for the goods during shipment, as required by law, are the responsibility of the consumer. It is therefore recommended to insure the product at the chosen courier, taking care to pack the goods carefully, where possible by inserting the original packaging in an outer box and, in any case, avoiding damaging the product with adhesive tapes, labels, etc. The product must be returned intact and complete with all its parts and accessories, including any warranties. In case of transport damage occurred during the return, IDENTITY SRL will notify the consumer of the damage within five business days of receipt of the product, allowing the consumer to make a complaint to the carrier used for transportation. The damaged goods will be made available for return and the request for withdrawal will be cancelled at the same time. Except as provided below for the case of partial withdrawal, IDENTITY SRL will refund, within 30 days from the time IDENTITY SRL became aware of the exercise of the right of withdrawal, the full amount of the purchase and the transportation costs for delivery, through a transfer procedure on the credit card or by bank transfer to the bank account indicated by the consumer; the transportation costs for the return of the product shall remain the responsibility of the consumer.

If the withdrawal is partial (i.e., it concerns only a portion of products delivered in a single delivery), reimbursement of shipping costs incurred by the consumer for delivery of the products at the time of purchase is excluded.

Request for Cancellation of Order

The purchase order may be cancelled in full if, at the time of the cancellation request, the shipment of the product is still being prepared and, in any case, if the amount has not yet been collected, in which case no charge will be made to the Customer. If at the time of the request for
cancellation of the purchase order, the product is already entrusted to the courier or, in any case, the amount has been collected, the consumer must exercise the right of withdrawal and return the goods to IDENTITY SRL. To this end, it is necessary to follow the above procedures for the exercise of the right of withdrawal.

Each User is prohibited, either for himself or on behalf of someone:
- use the site of IDENTITY SRL for illegal, illicit or unauthorized purposes or that may infringe any third party's rights, including industrial/intellectual property rights privacy rights, etc;
- impersonating others' identities, concealing one's identity or directly or indirectly providing false information;
- carry out through the Portal activities of propaganda, sponsorship, advertising or that have even indirectly professional commercial purposes;
